EXPLANATION OF SLEEPMULTIMEDIA NETWORK LICENSE AGREEMENT

 

Respect for intellectual labor and creativity is vital to academic discourse and enterprise. This principle applies to works of all authors and publishers in all media. It encompasses respect for the right to acknowledgement, right to privacy, and right to determine the form, manner, and terms of publication and distribution.

Because electronic information is volatile and easily reproduced, respect for the work and personal expression of others is especially critical in computer environments. Violations of authorial integrity, including plagiarism, invasion of privacy, unauthorized access, and trade secret and copyright violations, may be grounds for sanctions against members of the academic community.

The owner of a copyright holds exclusive right to the reproduction and distribution of his or her work. Therefore, it is illegal to duplicate or distribute software or its documentation without the permission of the copyright owner.

 

The SleepMultiMedia software license is a legal agreement between the purchaser and Sleep Multimedia Inc. and states:

 

 “Network license allows concurrent use on a single network with a DESIGNATED number of network stations at a SINGLE INSTITUTIONAL SITE. The software cannot be accessed from, or transferred, in whole or in part, outside a single institutional site. Licensee may not use SleepMultiMedia on a public computer based information service.”

 

The network license does not allow placing on a network so that the software can be accessed from outside of the single institutional site. The software cannot be placed on the internet. SleepMultiMedia cannot be placed on a network where the public can access the software, either with or without the use of a password.

 

The potential licensee should discuss the network use with Sleep Multimedia Inc. in advance of purchase to avoid any misuse of, and to ensure compliance with, the software license.

 

Any use of SleepMultiMedia that is not in accordance with the License agreement will result in legal liability.
